These Terms and Conditions ("Terms", "Terms and Conditions", or "Agreement") govern your relationship with the ByteBuzz website and mobile application (the "Service") operated by ByteBuzz Inc. ("us", "we", or "our"). Please read these Terms and Conditions carefully before using the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, candidates, recruiters, employers, and others who access or use the Service.

1. Introduction and Comprehensive Definitions

The terminology used throughout these Terms & Conditions applies to all agreements: "Client", "User", "You", and "Your" refers to you, the person logging onto this website. "The Company", "Ourselves", "We", "Our", and "Us" refers to ByteBuzz. "Party", "Parties", or "Us" refers to both the User and ourselves. All terms refer to the offer, acceptance, and consideration of necessary services required to assist the User in the most appropriate manner, particularly concerning job seeking, recruitment activities, talent acquisition, and professional networking. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

2. Eligibility and Account Registration

You must be at least 18 years of age to use this website. By using ByteBuzz and agreeing to these terms, you warrant and represent that you are at least 18 years of age and hold the legal capacity to enter into a binding contract. When creating an account, you agree to provide accurate, current, and complete information. You are solely responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel subscriptions in our sole discretion without prior notice or liability.

3. Services Provided by ByteBuzz and Scope of Platform

ByteBuzz operates as a digital bridge and online marketplace connecting job seekers (Candidates) and employers (Recruiters/Companies). We provide a platform where recruiters can post job openings and candidates can apply. However, we explicitly state that we do not act as an employer, headhunter, or traditional recruitment agency for any user. We do not guarantee employment, interviews, hiring outcomes, or the accuracy, validity, and legitimacy of any job listing posted by third parties. Candidates acknowledge that any employment relationship formed is strictly between the Candidate and the Employer, and ByteBuzz is exempt from any obligations regarding labor laws, workplace safety, compensation, or dispute resolution between the involved parties.

4. User Conduct and Acceptable Use Guidelines

While utilizing ByteBuzz, you agree to adhere to strict professional standards. You are strictly prohibited from:

• Posting false, inaccurate, misleading, or defamatory information regarding your resume, work experience, educational background, or company details.
• Using the platform for any unlawful purpose, fraud, or in violation of any local, state, national, or international law or regulation.
• Attempting to probe, scan, or test the vulnerability of the system or network, or bypassing our security measures.
• Distributing malware, viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
• Scraping, crawling, or using automated bots, spiders, or data mining tools to extract data from ByteBuzz without explicit, written, and signed consent.
• Harassing, abusing, threatening, or discriminating against other users, recruiters, or candidates on the platform based on race, religion, gender, sexual orientation, or disability.
• Selling, trading, or otherwise transferring your ByteBuzz account to another party.

5. User-Generated Content and License Grant

Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness. By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service to facilitate the recruitment process. You retain any and all of your rights to any Content you submit, post or display, and you are responsible for protecting those rights. We assume no liability for any Content posted by you or any third party.

6. Intellectual Property Rights and Copyright Policy

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of ByteBuzz and its licensors. The Service is protected by copyright, trademark, and other laws of both the domestic and foreign jurisdictions. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ByteBuzz. You may view and/or print pages from ByteBuzz for your own personal use, subject to restrictions set in these terms. You must not republish, sell, rent, reproduce, duplicate, or copy material from ByteBuzz without our prior explicit consent.

7. Third-Party Links and Services

Our Service may contain links to third-party web sites or services that are not owned or controlled by ByteBuzz. ByteBuzz has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that ByteBuzz shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

8. Disclaimers and Limitation of Liability

The information and services on ByteBuzz are provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, regarding the reliability, accuracy, completeness, or availability of the website. In no event shall ByteBuzz, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, loss of employment opportunities, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Indemnification

You agree to defend, indemnify and hold harmless ByteBuzz and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

10. Termination of Service

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the settings dashboard. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which ByteBuzz is headquartered, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration in accordance with commercial arbitration rules. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Modifications to Terms

ByteBuzz reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
